Terms and Conditions

These Terms describe the business rules for using VisibleOp's AI and search visibility portal, approval workflows, reports, and technical handoffs.

Pilot legal notice. This page is written for customer transparency and should be reviewed by counsel before paid production contracting.

1. Agreement

These Terms and Conditions govern access to and use of VisibleOp, including the website, portal, reports, technical audits, approval workflows, handoff files, and related services.

If a signed order form, pilot agreement, master services agreement, data processing agreement, or statement of work applies, that signed agreement controls where it conflicts with these Terms.

2. The service

VisibleOp is a managed AI and search visibility service. The service can measure how AI engines and search systems describe a business, identify technical visibility issues, maintain evidence records, prepare content or technical recommendations, and provide approval-gated handoffs.

VisibleOp does not guarantee search rankings, AI-engine citations, traffic increases, revenue, press coverage, inclusion in any index, or any particular response from third-party AI or search systems.

3. Accounts and authorized users

Customers are responsible for keeping account credentials secure, limiting access to authorized users, and promptly telling VisibleOp about suspected unauthorized access.

VisibleOp may suspend or restrict access if it reasonably believes an account is being misused, compromised, used unlawfully, or used in a way that could harm the service or third parties.

4. Customer responsibilities

Customers are responsible for the accuracy of the business information, domains, brand terms, competitors, query phrases, approval notes, and implementation instructions they provide.

Customers must have the rights and permissions needed to provide domains, content, brand assets, business data, connected accounts, and other materials to VisibleOp.

Customers are responsible for reviewing recommendations before use and for deciding whether to approve, reject, edit, publish, or implement any handoff.

5. Approvals and handoffs

Approval in the portal does not automatically publish content, edit a website, submit a public post, or change production systems unless a separate written workflow explicitly says so.

VisibleOp approval flows are designed to create clear records, PDFs, Markdown files, implementation notes, and evidence trails that a customer or their technical team can review and implement.

6. AI and search-engine limitations

AI engines, search engines, browsers, crawlers, and third-party platforms are outside VisibleOp control. Their outputs may be delayed, incomplete, inaccurate, inconsistent by language, or different across users, regions, and time.

VisibleOp may use AI systems to help analyze evidence, draft recommendations, summarize findings, or prepare content. Customers should review generated outputs before relying on them.

7. Acceptable use

Customers may not use VisibleOp to violate law, infringe rights, access systems without authorization, bypass security controls, harvest private personal data, generate spam, create fake reviews, manipulate votes or ratings, impersonate others, or publish deceptive endorsements.

Customers may not submit passwords, secret keys, payment card data, private customer records, health records, student records, or other sensitive regulated data unless a signed agreement specifically allows that processing.

8. Third-party services

VisibleOp may rely on third-party services for hosting, authentication, databases, email, analytics, AI and search measurement, crawler checks, payment processing, and infrastructure. Third-party services may have their own terms, policies, limits, outages, and data practices.

Customer use of connected third-party accounts, webmaster tools, analytics tools, AI engines, or social platforms remains subject to the customer's own agreements with those providers.

9. Fees and pilots

Fees, pilot terms, renewal terms, payment timing, taxes, refunds, usage limits, and cancellation rights should be stated in the applicable order form or signed agreement.

If no signed agreement applies, continued access may be conditioned on the customer paying agreed fees and complying with these Terms.

10. Intellectual property

VisibleOp owns the platform, software, workflows, templates, agent orchestration, user interface, know-how, and service methodology, except for customer materials and third-party materials.

Customers retain ownership of their pre-existing materials, brand assets, domains, and customer-provided business information. Subject to payment and any signed agreement, customers may use approved reports and handoff files for their internal business and implementation purposes.

Feedback or suggestions may be used by VisibleOp without restriction or obligation, unless a signed agreement says otherwise.

11. Confidentiality

Each party should protect non-public information received from the other party using reasonable care and use it only for the business relationship. Detailed confidentiality obligations should be finalized in a signed agreement for paid customers or regulated deployments.

12. Disclaimers

VisibleOp is provided on an "as is" and "as available" basis to the maximum extent allowed by law. VisibleOp does not provide legal, tax, investment, employment, healthcare, or regulatory advice.

Customers should have counsel review legal, privacy, compliance, employment, financial, healthcare, or regulated-industry recommendations before relying on them.

13. Limitation of liability

To the maximum extent allowed by law, VisibleOp will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, or business interruption.

Any liability cap, exclusions, indemnities, and dispute procedures should be finalized in the applicable signed agreement before production launch or paid customer contracting.

14. Termination

VisibleOp or the customer may end access according to the applicable order form or signed agreement. VisibleOp may suspend or terminate access for non-payment, security risk, unlawful use, material breach, or misuse of the service.

After termination, customer access may end, but VisibleOp may retain records where needed for security, legal compliance, billing, dispute resolution, or audit history.

15. Governing law and disputes

Governing law, venue, arbitration, notice procedures, and dispute escalation should be set in the applicable signed agreement. These draft Terms should not be treated as a final substitute for counsel-approved contracting terms.

17. Changes
